Legal
Terms of Service
Terms governing access to and use of the CaseWize AI platform.
Effective Date: September 9, 2026
These Terms of Service govern access to and use of the CaseWize AI litigation-intelligence platform and related services. They form a binding agreement between CaseWize AI, Inc. and the customer accepting them. Please read them carefully. CaseWize provides technology for legal professionals; it does not provide legal advice or replace the independent professional judgment of a licensed attorney.
1 Acceptance and Contracting Party
These Terms of Service (the “Terms”) are entered into between CaseWize AI, Inc., a Delaware corporation (“CaseWize,” “Company,” “we,” “us,” or “our”), and the person or entity that accesses or uses the Services (“Customer,” “you,” or “your”). “Services” means the CaseWize websites, software platform, applications, artificial-intelligence features, support, and related services that CaseWize makes available.
By creating an account, clicking to accept these Terms, signing an Order Form that references them, or accessing or using the Services, you agree to these Terms. If you do not agree, do not access or use the Services. If you accept these Terms for a law firm, company, or other organization, you represent that you have authority to bind that organization; in that event, “Customer” refers to that organization.
2 Eligibility and Business Use
You must be at least 18 years old and legally capable of entering into a binding agreement. The Services are intended for business and professional use, not personal, family, or household use. You may use the Services only in compliance with applicable law, professional-responsibility obligations, court rules, protective orders, client instructions, and contractual duties.
3 Order Forms and Order of Precedence
An “Order Form” means an ordering document, online checkout page, proposal, statement of work, or similar document that identifies the Services, subscription term, fees, usage limits, or other commercial terms. If there is a conflict, the following order controls: (a) a signed Data Processing Addendum, but only for data-protection matters; (b) the applicable Order Form; (c) these Terms; and (d) other policies referenced in these Terms. An Order Form changes these Terms only if it expressly identifies the provision being changed and is accepted by authorized representatives of both parties.
4 The Services
CaseWize provides artificial-intelligence-powered litigation technology designed to assist attorneys and legal professionals with activities such as case intake and evaluation, document analysis, evidence organization, chronology and timeline generation, legal-research assistance, case scoring, strategy support, defense-document analysis, workflow recommendations, case-status assessment, and client communications.
CaseWize may improve, modify, or discontinue features over time. We will not materially reduce the core functionality of a paid Service during a current subscription term without reasonable advance notice, except when necessary to address security, legal, or third-party-service requirements. New or materially different features may be subject to additional terms or fees.
5 License and Authorized Users
Subject to Customer’s payment of applicable fees and compliance with these Terms, CaseWize grants Customer a limited, non-exclusive, non-transferable, non-sublicensable right during the subscription term to access and use the Services for Customer’s internal professional and business purposes.
“Authorized User” means an employee, attorney, contractor, or other individual whom Customer authorizes to use the Services for Customer’s benefit. Customer is responsible for its Authorized Users and for all activity under its accounts. Login credentials are assigned to individuals and may not be shared. Customer must promptly notify CaseWize at info@casewize.com if it knows or reasonably suspects that an account or credential has been compromised.
6 Customer Responsibilities
Customer is responsible for determining whether the Services are appropriate for its matters and for configuring and using them appropriately. Customer must maintain reasonable administrative, technical, and physical safeguards for its accounts and devices. Customer is responsible for obtaining all consents, authorizations, and notices required to submit Customer Data to the Services and for giving only appropriate personnel access to matters and client information.
Customer must not treat CaseWize as the system of record for filing deadlines, limitation periods, court dates, original evidence, or documents that Customer is legally required to preserve. Customer should maintain independent copies and reliable calendaring, case-management, and backup procedures.
7 Customer Data
7.1 Definition and ownership
“Customer Data” means documents, files, communications, prompts, instructions, factual information, personal information, case materials, and other content submitted to the Services by or for Customer, together with content extracted from those materials. As between the parties, Customer retains all right, title, and interest in Customer Data. These Terms do not transfer ownership of Customer Data to CaseWize.
7.2 Limited processing license
Customer grants CaseWize and its subprocessors a limited, non-exclusive license to host, copy, transmit, index, extract, transform, analyze, display, and otherwise process Customer Data only as necessary to provide, maintain, secure, support, and improve the Services for Customer; comply with Customer’s documented instructions; prevent fraud or misuse; and comply with law. This license ends when the relevant Customer Data is deleted from active systems, subject to the retention and backup provisions below.
7.3 Customer representations
Customer represents and warrants that it has all rights, permissions, and lawful bases necessary to submit and authorize the processing of Customer Data; that its submission and use will not violate law, court order, protective order, contract, or third-party rights; and that it will not submit information prohibited by an Order Form or applicable product documentation.
8 No Training on Customer Data
Except with Customer’s express prior written authorization, CaseWize will not use Customer Data, prompts, matter-specific outputs, embeddings, or extracted text to train or fine-tune generalized artificial-intelligence or machine-learning models, and will not permit its subprocessors to do so. CaseWize may use telemetry, service-performance information, and aggregated or de-identified information that cannot reasonably identify Customer, an Authorized User, a client, a matter, or any person to operate, secure, analyze, and improve the Services. CaseWize will not attempt to re-identify such information.
9 Confidentiality and Legal Privilege
9.1 Confidential Information
“Confidential Information” means nonpublic information disclosed by or for a party that is marked confidential or that reasonably should be understood to be confidential given its nature and the circumstances of disclosure. Customer Confidential Information includes Customer Data, client information, case strategy, work product, credentials, and account information. CaseWize Confidential Information includes nonpublic software, models, scoring methods, algorithms, prompts, security information, pricing, product plans, and documentation.
9.2 Protection and permitted use
The receiving party will use the disclosing party’s Confidential Information only to perform or exercise rights under the Agreement; protect it using at least reasonable care and no less care than it uses for similar information of its own; and disclose it only to personnel, professional advisers, and subprocessors who need access and are bound by confidentiality duties at least as protective as those in these Terms. The receiving party is responsible for breaches by those recipients.
9.3 Exclusions and compelled disclosure
Confidential Information does not include information that the receiving party can document: (a) is or becomes public without breach; (b) was lawfully known without restriction before disclosure; (c) is received lawfully from a third party without confidentiality duty; or (d) is independently developed without use of the disclosing party’s Confidential Information. If disclosure is legally required, the receiving party will, to the extent legally permitted, give prompt notice and reasonable assistance so the disclosing party may seek protection.
9.4 Privilege and work product
The parties acknowledge that Customer Data may include attorney-client privileged communications, attorney work product, and other legally protected material. CaseWize receives and processes such material solely as Customer’s technology service provider and does not claim ownership of it. The parties intend that disclosure to CaseWize not waive any applicable privilege or protection. Customer remains responsible for assessing privilege, confidentiality, and ethical requirements for each use of the Services.
10 Privacy and Data Processing
CaseWize will process personal information in accordance with its Privacy Policy, available at www.casewize.com/privacy, and applicable law. If CaseWize processes personal information for Customer as a service provider, contractor, processor, or comparable role under applicable privacy law, the parties will comply with the CaseWize Data Processing Addendum when required. If there is a conflict concerning personal-information processing, the Data Processing Addendum controls.
Customer is responsible for providing required notices and responding to individuals whose information Customer controls. CaseWize will provide reasonable assistance with legally required access, correction, deletion, or similar requests as described in the Data Processing Addendum or applicable documentation.
11 Security
CaseWize will maintain commercially reasonable administrative, technical, and organizational safeguards designed to protect Customer Data against unauthorized access, use, alteration, disclosure, and destruction. Safeguards may include access controls, encryption in transit and at rest where supported, logging and monitoring, vulnerability management, secure development practices, personnel confidentiality obligations, and incident-response procedures appropriate to the nature of the Services and data.
No system is completely secure. Customer acknowledges that internet transmission and electronic storage involve risk. CaseWize does not warrant that unauthorized third parties will never defeat security measures, but this acknowledgment does not limit CaseWize’s express security obligations under the Agreement.
12 Security Incidents
A “Security Incident” means a confirmed unauthorized acquisition of, access to, or disclosure of Customer Data in CaseWize’s possession or control. A Security Incident does not include unsuccessful attempts that do not compromise Customer Data, such as blocked probes, pings, denial-of-service attempts, or unsuccessful login attempts.
CaseWize will notify Customer without undue delay after confirming a Security Incident, provide information reasonably available about its nature and likely consequences, take reasonable steps to contain and remediate it, and reasonably cooperate with Customer’s legally required response. CaseWize’s notice is not an admission of fault or liability. Customer is responsible for notifying CaseWize of incidents originating from Customer accounts, systems, or credentials.
13 Subprocessors and Third Party Services
CaseWize may use cloud-hosting providers, document-processing vendors, model providers, payment processors, analytics providers, and other subprocessors to provide the Services. CaseWize remains responsible for its subprocessors’ performance of CaseWize’s obligations under the Agreement and will require subprocessors that process Customer Data to maintain appropriate confidentiality, security, and data-use restrictions.
The Services may interoperate with third-party products selected or enabled by Customer. Customer’s use of those products is governed by the third party’s terms and privacy practices. CaseWize is not responsible for third-party products that are not CaseWize subprocessors or for Customer’s instructions to transfer data to them.
14 Artificial Intelligence and Professional Review
The Services use probabilistic and evolving technologies. Outputs may be incomplete, inaccurate, outdated, misleading, biased, duplicative, or unsuitable for a particular matter. Outputs may include fabricated or incorrect facts, quotations, authorities, citations, calculations, deadlines, procedural requirements, or recommendations. Case scores, outcome assessments, damages considerations, and strategic analyses are decision-support tools, not guarantees or predictions of results.
Customer and its attorneys must independently review and verify outputs before relying on, communicating, filing, or acting on them. This includes verifying source documents, facts, legal authorities, quotations, citations, jurisdiction, currency of law, deadlines, calculations, and strategic recommendations. A licensed attorney’s professional judgment must control all legal work and decisions. Customer must not delegate the practice of law or any nondelegable professional duty to the Services.
15 No Legal Advice or Professional Relationship
CaseWize is a technology company, not a law firm, legal-services provider, expert witness, court, settlement adviser, or litigation funder. The Services and outputs do not constitute legal advice, legal representation, an expert opinion, or a recommendation to accept or reject a case or settlement. Use of the Services does not create an attorney-client, fiduciary, expert-client, or other professional relationship between CaseWize and Customer, Customer’s clients, or any other person.
16 Outputs
“Outputs” means analyses, summaries, chronologies, scores, recommendations, drafts, and other content generated by the Services in response to Customer Data or instructions. Subject to Customer’s compliance with the Agreement and to the extent permitted by applicable law, CaseWize assigns to Customer any right, title, and interest CaseWize may have in matter-specific Outputs generated for Customer. Customer may use and modify those Outputs for its internal professional purposes and client work.
CaseWize retains all rights in the Services and in its underlying and pre-existing technology, models, algorithms, scoring systems, templates, workflows, interfaces, know-how, improvements, and generic elements, even if reflected in an Output. Because artificial intelligence can generate similar content for different users, Outputs may not be unique, and Customer receives no rights in outputs generated for others.
17 CaseWize Intellectual Property
CaseWize and its licensors own the Services, software, models, algorithms, proprietary scoring methods, workflows, designs, interfaces, databases, documentation, trademarks, logos, and all related intellectual-property rights. Except for the limited rights expressly granted in the Agreement, no rights are granted by implication, estoppel, or otherwise. Customer may provide feedback, and CaseWize may use it without restriction or payment, provided CaseWize does not identify Customer or disclose Customer Confidential Information.
18 Acceptable Use
Customer and Authorized Users must not, and must not assist others to:
- use the Services in violation of law, professional rules, court orders, sanctions, export controls, or third-party rights;
- upload malware, destructive code, unlawfully obtained material, or content Customer is not authorized to process;
- gain or attempt unauthorized access to the Services, another account, or any related network or system;
- interfere with, disrupt, overload, probe, scan, or test the vulnerability of the Services except under a written CaseWize security-testing authorization;
- reverse engineer, decompile, disassemble, copy, frame, mirror, scrape, or derive source code, models, prompts, algorithms, or nonpublic components, except to the limited extent a restriction is prohibited by law;
- use the Services or Outputs to develop, train, benchmark, or improve a competing product or model, or publish benchmark results without CaseWize’s prior written consent;
- resell, rent, sublicense, time-share, or provide the Services to third parties except as expressly permitted in an Order Form;
- remove proprietary notices or misrepresent the source, reliability, or human review of an Output; or
- use the Services to harass, discriminate, defraud, deceive, or cause unlawful harm.
19 Fees Taxes and Payment
Customer will pay the fees stated in the applicable Order Form. Unless stated otherwise, fees are in U.S. dollars, invoiced in advance, non-cancelable during the committed subscription term, and non-refundable except as expressly provided in the Agreement. Customer is responsible for sales, use, value-added, and similar taxes, excluding taxes on CaseWize’s net income.
Undisputed invoices are due within the period stated in the Order Form. Customer must notify CaseWize of a good-faith billing dispute before the due date or within 30 days after the invoice date, whichever is later, and timely pay undisputed amounts. Overdue undisputed amounts may accrue interest at the lesser of 1.0% per month or the maximum lawful rate. CaseWize may suspend access for overdue undisputed fees after reasonable written notice and an opportunity to cure.
20 Free Trials Beta Features and Evaluations
CaseWize may offer a free trial, pilot, beta, preview, or evaluation (“Evaluation Services”). The applicable offer or Order Form controls its duration, scope, limits, and conversion terms. Unless Customer receives clear advance disclosure and affirmatively authorizes conversion, a free trial will not automatically convert to a paid subscription. Customer may cancel an Evaluation Service before conversion through the method identified in the offer or account settings.
Evaluation Services may be changed or discontinued at any time and are provided without service-level commitments. To the maximum extent permitted by law, CaseWize’s aggregate liability arising from Evaluation Services will not exceed $100. Confidentiality, data-use, security, and no-training obligations continue to apply to Evaluation Services unless the applicable offer expressly states that real client or confidential data must not be submitted.
21 Subscription Term Renewal and Cancellation
The initial subscription term is stated in the Order Form. Unless the Order Form states otherwise, a paid subscription automatically renews for successive periods equal to the shorter of the initial term or 12 months unless either party gives notice of nonrenewal at least 30 days before the current term ends. CaseWize will provide any renewal notices required by applicable law.
Customer may provide nonrenewal notice through available account settings or by emailing info@casewize.com. Cancellation stops future renewal but does not end the then-current committed term or entitle Customer to a refund, except as required by law or expressly provided in the Agreement. If CaseWize materially increases recurring fees for a renewal term, it will provide reasonable advance notice before the nonrenewal deadline.
22 Suspension
CaseWize may suspend access to all or part of the Services when reasonably necessary to prevent or address a security threat, unlawful use, material breach of the Acceptable Use section, harm to the Services or others, or overdue undisputed fees. When practicable, CaseWize will provide advance notice and limit the suspension to the affected account, user, data, or function. CaseWize will restore access promptly after the basis for suspension is resolved.
23 Termination
Either party may terminate the Agreement if the other party materially breaches it and fails to cure within 30 days after written notice. CaseWize may terminate immediately for unlawful conduct, a material security threat, insolvency, or a breach that cannot reasonably be cured. Customer may terminate immediately if continued use would violate applicable law or binding professional obligations and the parties cannot reasonably resolve the issue.
If Customer terminates for CaseWize’s uncured material breach, or CaseWize discontinues a paid Service during a current term for reasons unrelated to Customer’s breach, CaseWize will refund prepaid fees covering the unused portion of the terminated Service. If CaseWize terminates for Customer’s breach, unpaid fees for the committed term remain due to the extent permitted by law.
24 Data Export Retention and Deletion
During the subscription term, Customer may export Customer Data and available Outputs using supported features. For 30 days after termination or expiration, CaseWize will, upon Customer’s timely request and subject to payment of undisputed fees, make Customer Data reasonably available for export in a commonly used format where technically feasible.
After that period, CaseWize may delete Customer Data from active systems in accordance with its retention schedule, unless law requires retention or the parties agree otherwise. Residual copies may remain temporarily in encrypted or access-restricted backups and will be deleted or rendered inaccessible through the ordinary backup cycle. CaseWize may retain records necessary for security, fraud prevention, billing, dispute resolution, and legal compliance. Confidentiality and data-use restrictions continue while retained data remains in CaseWize’s possession or control.
25 Availability Support and Maintenance
CaseWize will use commercially reasonable efforts to make paid Services available, excluding scheduled maintenance, emergency maintenance, events outside reasonable control, internet or third-party infrastructure failures, and Customer systems. Unless an Order Form includes a service-level agreement, CaseWize does not guarantee a particular uptime or response time. CaseWize may perform maintenance and will provide advance notice of material planned interruptions when reasonably practicable.
26 Warranties
Each party represents that it has authority to enter into the Agreement. CaseWize warrants that, during a paid subscription term, the Services will perform in all material respects in accordance with then-current documentation when used as authorized. Customer’s exclusive remedy for breach of this warranty is for CaseWize to use commercially reasonable efforts to correct the nonconformity; if CaseWize cannot do so within a reasonable period, Customer may terminate the affected Service and receive a prorated refund of prepaid fees for the unused portion.
27 Disclaimers
EXCEPT FOR THE EXPRESS WARRANTIES IN THE AGREEMENT AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES, EVALUATION SERVICES, DOCUMENTATION, AND OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” CASEWIZE AND ITS LICENSORS DISCLAIM ALL IMPLIED OR STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
CASEWIZE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE; THAT OUTPUTS WILL BE COMPLETE, CURRENT, ACCURATE, UNIQUE, OR SUITABLE FOR A PARTICULAR MATTER; OR THAT USE OF THE SERVICES WILL PRODUCE A PARTICULAR CASE, BUSINESS, FINANCIAL, SETTLEMENT, OR LITIGATION OUTCOME. THESE DISCLAIMERS DO NOT LIMIT AN EXPRESS OBLIGATION IN THE AGREEMENT.
28 Indemnification
28.1 Customer indemnification
Customer will defend CaseWize and its officers, directors, employees, and affiliates against a third-party claim arising from (a) Customer Data as submitted or used by Customer; (b) Customer’s unlawful or unauthorized use of the Services; or (c) Customer’s material breach of the Acceptable Use section, and will indemnify them against damages and reasonable costs finally awarded or agreed in a settlement approved under this section.
28.2 CaseWize intellectual property indemnification
CaseWize will defend Customer against a third-party claim that Customer’s authorized use of the paid Services infringes a United States patent, copyright, or trademark or misappropriates a trade secret, and will indemnify Customer against damages and reasonable costs finally awarded or agreed in a settlement approved under this section. CaseWize has no obligation for claims arising from Customer Data, Outputs resulting from Customer Data or instructions, modifications not made by CaseWize, combinations not supplied or required by CaseWize, continued use after notice, or use contrary to the Agreement or documentation.
If an infringement claim appears likely, CaseWize may obtain the right for continued use, modify or replace the affected Service, or terminate it and refund prepaid fees for the unused portion. This section states Customer’s exclusive remedy for third-party intellectual-property claims concerning the Services.
28.3 Procedure
The indemnified party must promptly notify the indemnifying party of the claim, provide reasonable cooperation at the indemnifying party’s expense, and allow the indemnifying party to control the defense and settlement. Delay in notice relieves the indemnifying party only to the extent materially prejudiced. A settlement may not admit fault by, impose nonmonetary obligations on, or require payment from the indemnified party without its prior written consent, not to be unreasonably withheld.
29 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY NOR ITS LICENSORS WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, OR ANTICIPATED SAVINGS; LOSS OR CORRUPTION OF DATA; OR THE COST OF SUBSTITUTE SERVICES, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.
EXCEPT FOR THE EXCLUSIONS BELOW, EACH PARTY’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE AGREEMENT WILL NOT EXCEED THE FEES PAID OR PAYABLE BY CUSTOMER FOR THE SERVICES GIVING RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE EVENT FIRST GIVING RISE TO LIABILITY.
The exclusions from the liability cap are Customer’s payment obligations and either party’s fraud, willful misconduct, or liability that cannot lawfully be limited. Liability arising from a party’s breach of confidentiality obligations, CaseWize’s breach of its express no-training obligations, or a party’s indemnification obligations will not exceed two times the general cap. Multiple claims do not expand a cap. The limitations apply regardless of the legal theory and reflect the allocation of risk between the parties.
30 Compliance with Laws
Each party will comply with laws applicable to its performance under the Agreement. Customer will comply with professional-responsibility rules, court rules, protective orders, discovery obligations, litigation holds, export controls, and economic sanctions applicable to its use. Customer may not use or export the Services in violation of United States export-control or sanctions laws or permit access by a prohibited person or from a comprehensively sanctioned jurisdiction.
31 Publicity
CaseWize will not publicly identify Customer or use Customer’s name, trademarks, case information, or client information in marketing without Customer’s prior written consent. Any approved use must comply with the scope and duration of that consent.
32 Dispute Resolution Governing Law and Venue
Before filing a lawsuit, a party must give written notice describing the dispute, and business representatives with authority to resolve it will attempt in good faith to do so for 30 days. This requirement does not prevent either party from seeking temporary or emergency injunctive relief, protecting intellectual property or confidential information, or filing before a limitations period expires.
The Agreement is governed by California law, without regard to conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Subject to the preceding paragraph, each party consents to the exclusive jurisdiction and venue of the state courts located in Contra Costa County, California, and the United States District Court for the Northern District of California. Nothing in the Agreement waives a right or remedy that cannot lawfully be waived.
33 Changes to These Terms
CaseWize may update these Terms. For changes that materially reduce Customer’s rights or increase Customer’s obligations during a paid subscription term, CaseWize will provide at least 30 days’ advance notice by email, in-product notice, or another reasonable method. Unless required sooner by law or security needs, a material change will take effect at the next renewal for an existing paid subscription. Other changes take effect on the stated effective date. Continued use after the effective date constitutes acceptance to the extent permitted by law.
34 Notices
Legal notices to CaseWize must be sent to info@casewize.com and, if an Order Form lists a mailing address for CaseWize, by nationally recognized overnight courier or certified mail to that address. Notices to Customer may be sent to the account administrator or billing email address on file. Notices are effective upon receipt, except email notice is effective on the next business day if no delivery-failure notice is received. Routine support, billing, security, and product communications may be sent electronically.
35 General Terms
35.1 Assignment
Neither party may assign the Agreement without the other party’s prior written consent, except either party may assign it without consent in connection with a merger, reorganization, change of control, or sale of substantially all assets relating to the Agreement, provided the assignee is not a direct competitor of the nonassigning party and assumes the assigning party’s obligations. Any prohibited assignment is void.
35.2 Force majeure
Neither party is liable for delay or failure caused by events beyond its reasonable control, excluding payment obligations. The affected party will use reasonable efforts to mitigate the impact and resume performance.
35.3 Independent contractors
The parties are independent contractors. The Agreement does not create a partnership, joint venture, employment, agency, fiduciary, franchise, or exclusive relationship. Neither party may bind the other.
35.4 No third party beneficiaries
The Agreement benefits only the parties and their permitted successors and assigns. It creates no rights for any other person, including Customer’s clients or Authorized Users.
35.5 Waiver and severability
A waiver must be in writing and applies only to the specific instance. Failure to enforce a provision is not a waiver. If a provision is unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the remainder will remain effective.
35.6 Entire agreement
The Agreement consists of these Terms, applicable Order Forms, the Privacy Policy, any applicable Data Processing Addendum, and documents expressly incorporated by reference. It is the entire agreement concerning the Services and supersedes prior or contemporaneous proposals, communications, and understandings on that subject. Purchase-order terms do not apply unless expressly accepted in writing by CaseWize.
35.7 Interpretation and electronic acceptance
Headings are for convenience only. “Including” means “including without limitation.” A reference to writing includes email where these Terms permit email notice. Electronic acceptance, signatures, and records have the same effect as originals to the extent permitted by law.
35.8 Survival
Provisions that by their nature should survive termination will survive, including provisions concerning ownership, Customer Data, confidentiality, accrued payment obligations, disclaimers, indemnification, liability limitations, dispute resolution, and general terms.
